The Minister for Justice and Equality, Alan Shatter, has approved a new code of practice on harassment and sexual harassment in the workplace (SI no. 2008 of 2012).
The code of practice is an approved code under the Employment Equality Act 1998, and replaces the 2002 code on the same topic.
Although the code does not actually impose legal obligations, any code of practice issued under the Employment Equality Acts is admissible into evidence and will be taken into account if relevant to proceedings, including court proceedings or those before the employment rights bodies.
Most employers presently have a sophisticated dignity at work policy or anti-bullying and harassment policy in force, however if you do not, it is essential to introduce a policy as one of your essential policies for all employees.
There are minor differences between the 2002 and 2012 codes, but to ensure best practice and compliance, employers are advised to review the new code and update policies accordingly. Contact Voltedge for further information contact@voltedge.ie
