The Government issue Code of Practice in accordance with the Construction Contracts Act, 2013.
Minister for Business and Employment, Ged Nash TD on February 19th circulated a comprehensive Code of Practice for the conduct of adjudications, in accordance with the Construction Contracts Act, 2013, to the relevant stakeholder organisations.
The publication of this Code is the third and final step required to be taken under this far-reaching legislation and will clear the way for the commencement of the Act.
With some exceptions the Construction Contracts Act, 2013 provides new minimal contractual provisions regarding payment arrangements between parties to a construction contract. Where disputes arise the parties will have the right to refer for adjudication to be concluded within a set time frame. Where the parties cannot agree on an adjudicator the chairperson of the Ministerial Panel will appoint one.
